The Family Law Section of the Idaho State Bar designs and sponsors statewide seminars on timely topics and practice updates. The section meets the second Friday of each month at 12:00 p.m. (MT) either via telephone conference OR at The Law Center, 525 W. Jefferson Street - Boise (see list below).

Section Governing Council Members and Seats Get New Roles

There is a significant change regarding the roles and responsibilities for officers and council members at large. Once an officer is elected, that person will serve a four-year term serving the first year as the Secretary/Treasurer; the second as Vice Chairperson; the third as Chairperson; and the fourth as Past Chairperson.  Mid-term vacancies that may occur from time-to-time will follow this succession with a new appointment to the Secretary/Treasurer position by the Chairperson, subject to the next election cycle. Previously, the Past Chairperson was not technically a member of the Governing Council.  The Past Chairperson is a non-voting Council member with the duties of advising the Council and Section, attending Council meetings, and such other duties as the Chairperson assigns. In addition to their other responsibilities, Officers and Governing Council members at large will serve specific functions by coordinating “Seats” that serve the goals and objectives of the Governing Council. The Coordinators can seek team members from the Section to assist in the accomplishment of their Seat responsibilities. The Coordinators for the first two seats are the officers as listed. The other seats are to be appointed Coordinators from among the council members by the Chairperson at the annual organizational meeting each April.

Following is a brief description of the Seats:
Seat 1 - Community Property Symposium and national (or international) conference participation: Chairperson is the assigned Coordinator. The Chairperson and Secretary (or their designee(s)) attend the Symposium each year and the Vice Chairperson and Past Chairperson (or their designee(s)) attend a conference each year.
Seat 2 - October CLE: Vice Chairperson is the assigned Coordinator.
Seat 3 - Other CLE and cross training endeavors.
Seat 4 - Reports on proposed legislation & rules.
Seat 5 - Publications (Handbook, Form Book, Advocate articles).
Seat 6 - Technology (information flow, list-serve, website, case law update).
Seat 7 - District support (relationships among and between section members, local district section groups, Idaho Supreme Court, other Idaho State Bar sections, public, etc.).
Seat 8 - Resource coordination (database for local decision bank, people [evaluators, issue specialists: financial, employment, domestic violence, child development, alienation, etc.], speakers-trainers, information – articles relevant to family law practice)
Seat 9 - Special projects and awards (including the annual Family Law Award of Distinction).
Seat 10 - This seat is intentionally not specified but will fill functions as they become obviously necessary.

Idaho's Child Protective Act and Termination of Parent-Child Relationship Statutes

In the 2013 session, the Idaho Legislature approved amendments to Idaho’s Child Protective Act and Termination of Parent-Child Relationship Statutes. In addition, the Idaho Supreme Court recently approved amendments to several Idaho Juvenile Rules that relate to child protection cases.  The amendments include changes in the appointment of counsel for children and guardians ad litem, clarification of the definition of aggravated circumstances, projected  timelines for the completion of reunification, guardianship and adoption, changes in the timing of the petition for termination of parental rights, moving provisions regarding the case and permanency plans to the Child Protective Act from the Idaho Juvenile Rules, as well as other amendments. The amendments to the statutes and rules are effective July 1, 2013. 

Award of Distinction

Each year, the Family Law Section presents an Award of Distinction to a member of the bar, the judiciary, or the public who has provided outstanding service in the realm of family law. Nominations are requested for lawyers, judges, or citizens connected with family law, who has distinguished themselves during their career in the advancement of family law in Idaho. Section membership is not a requirement, though support of the Family Law Section might well be one of the elements of the nominee’s distinction on behalf of family law.
