Idaho State Bar recognizes North Idaho members at Annual Resolution Meeting

October 31, 2017-Coeur d’Alene, Idaho—The Idaho State Bar will be recognizing three of its North Idaho members during the Annual First District Bar Association Resolution Meeting to be held at North Idaho College on Thursday, November 2 at Noon.

  • Ausey H. “Rusty” Robnett will receive the Professionalism Award, given to at least one attorney in each of Idaho’s seven judicial districts who has engaged in extraordinary activity in his or her community, in the state, or in the profession, which reflects the highest standards of professionalism. Robnett is with Lake City Law Group, PLLC, with offices in Coeur d’Alene and Priest River, Idaho and in Spokane, WA. He has been an Idaho lawyer for 33 years and is a graduate of Northwestern School of Law and Lewis and Clark College. Robnett resides in Coeur d’Alene.

 

  • Alycia T. Moss will receive the Denise O’Donnell Day Pro Bono Award, presented to the person(s) from each judicial district that has donated extraordinary time and effort to help clients who are unable to pay for legal services. In 2016, Moss wrapped up 150 hours of pro bono work on an immigration case in which she obtained asylum for a victim of domestic violence while simultaneously engaging in ongoing representation of several other pro bono clients. Moss is with Smith + Malek with offices in Coeur d’Alene, Sandpoint and Boise. She has been practicing in Idaho for 12 years and is a graduate of the University of Idaho College of Law. Moss resides in Coeur d’Alene.

 

  • The Honorable Debra A. Heise of Sandpoint will be recognized as a Retiring Judge. She served Bonner County and the First Judicial District as a Magistrate Judge. Judge Heise is a graduate of Florida State University School of Law.

Idaho Supreme Court Rule Amendments

Amendment to Appellate Rule on Certified Questions From a Federal Court.

Effective January 1, 2018, I.A.R. 12.3 on certification of a question of law from a United States Court has been amended with the intent to expedite these cases.  Any opposition to the certification will have to be filed with the Supreme Court within seven days of the date of the filing of the order of certification and the filing of briefs will follow an expedited schedule set out in the rule.  In addition, if oral argument is held, it will be given priority on the court’s calendar behind arguments in custody appeals filed pursuant to I.A.R. 11.1 or   12.1.  The order amending the rule can be found at https://isc.idaho.gov/rules/Order_Amending_IAR_12.3.01.18.pdf.

Description

These positions require individuals to be able to perform one or more of the following functions, including but not limited to: speak with borrowers and prepare associated legal documents, review closing documents, and validate deeds and collateral.  While a background in these areas is useful, training on all required tasks will be provided by SBA Staff. Personnel will be located in one of our 3 processing centers in Sacramento, CA, Dallas, TX, or Buffalo, NY.

Qualifications

Due to the broad array of required legal tasks we are looking for individuals with a range of qualifications.  The positions call for skill sets with a background in law, so attorneys and paralegals and legal assistants are encouraged to apply.  In addition to the above qualifications any applicant with fluency in a foreign language is encouraged to highlight their language and level of proficiency on their application.

Expectations

All legal specialists will become temporary SBA employees and as such will be required to meet the following requirements:

  • Be a U.S. Citizen
  • Pass a credit and background check
  • Able to work between 40 to 84 hours a week based upon case load

Compensation

The SBA will cover all travel and per diem based on the government rate for every individual.  Compensation will be based on each individual’s qualifications, skillsets, responsibility, hours, and location.  Compensation for attorneys and paralegals will range from $25.41 to $39.96 per hour.  Overtime ($38.12 to $41.97) will be paid for hours over 40 weekly.  Compensation for legal assistants will range from $16.77 to $27.01 per hour.  Overtime ($25.16 to $40.52) will be paid for hours over 40 weekly.

New ABA Information

The ABA is very concerned about assuring that legal assistance is available to victims of hurricane disasters in Puerto Rico and the US Virgin Islands. Among our efforts, we have been working closely with the Louisiana Civil Justice Center (LCJC) to create a hotline that can provide needed information and services through pro bono volunteers. LCJC has long experience in providing disaster legal services to callers. Because there is such severe devastation on those islands, local lawyers will probably not be able to provide sufficient pro bono service to meet the growing need for legal help. Therefore:

  • Lawyers who are active members of the USVI or Puerto Rico bars are urged to sign up to accept referrals of pro bono cases from the LCJC.

AND

  • Lawyers who are not licensed in USVI or Puerto Rico can also assist, by providing legal research or assistance with federal/administrative law questions.
