Keynote Speaker – Chief Justice Nathan Hecht

Texas Supreme Court

Chief Justice Hecht is the 27th chief justice of the Texas Supreme Court. He has been elected to the court six times, first in 1988 as a justice, and most recently in 2014 as chief justice. He is the longest-serving member of the court in Texas history and the senior Texas appellate judge in active service. Throughout his service on the court, Chief Justice Hecht has overseen revisions to the rules of administration, practice and procedure in Texas courts, and was appointed by the chief justice of the United States to the federal Advisory Committee on Civil Rules. The lecture will address the topic of access to justice.

The Denton Darrington Annual Lecture on Law and Government was begun in 2013 to honor former Idaho State Senator Denton Darrington who served as chair of the Senate Judiciary Committee for 23 years.  The lecture is sponsored by the University of Idaho College of Law, the Idaho Supreme Court, and the Idaho State Bar and Law Foundation.  The lecture series is designed to address a wide range of topics related to the improved administration of justice and features national, state and regional speakers to address Idaho citizens, students, and officials from all three branches of government.

Nominations for the 2018 ISB Commissioner Election Due April 3, 2018 – Attorneys in the Sixth and Seventh districts will be electing a new representative to the Idaho State Bar Board of Commissioners this spring. The new commissioner will replace Kent Higgins (Pocatello). Pursuant to Idaho Bar Commission Rule 900, the new commissioner representing the Sixth and Seventh districts must reside or maintain an office in the Seventh district. Commissioners of the Idaho State Bar – the elected governing body of the Bar – serve for three (3) years, beginning on the last day of the ISB Annual Meeting following their elections. The Board of Commissioners is charged with regulating the legal profession in Idaho, which includes the testing, admission, and licensing of attorneys, overseeing disciplinary functions and administering mandatory continuing legal education requirements.

Nominations must be in writing and signed by at least five (5) members of the ISB in good standing, and eligible to vote in the districts. The Executive Director must receive nominations no later than the close of business on Tuesday, April 3, 2018. A nominating petition form may be obtained by calling the office of the Executive Director at (208) 334-4500 or on the ISB website at www.isb.idaho.gov. Ballots will be distributed electronically to all members eligible to vote in the Sixth and Seventh Districts on Monday, April 16. All ballots properly cast and returned to the ISB office will be counted by a Board of Canvassers at the close of business on Tuesday, May 1.

The Attempt to Trump DACA:
The Constitutional and Administrative Limits of President Trump’s Rescission of DACA

Luis Cortes Romero is an alumnus of the University of Idaho College of Law, and one of the lead attorneys, alongside Dean Erwin Chemerinsky, Professor Laurence Tribe, and Professor Leah Litman, in Garcia v. United States of America, 3:17-cv-05380 (N.D. Cal.) – the companion case in the national DACA litigation.  He will discuss the litigation that led to the court order preventing President Trump from rolling back the DACA program, the future of DACA at the Supreme Court, the situation facing DREAMers today, and his path through the legal profession. Cortes Romero’s work was recently profiled by PBS News Hour.

 Background:

In 2012, the Obama administration created the DACA program through policy statements. The program offered work permits and temporary protection from deportation to undocumented immigrants who had been brought to the United States as children. As of 2017, there were an estimated 800,000 DACA recipients. On September 5, 2017, President Trump announced that he was ending the program in March unless congress acts within the next six months.

Cortes Romero represented six individuals who were brought into the U.S. at young ages and currently live, work, and study in California in their challenge to President Trump’s announcement. One is a practicing attorney, one is a special education teacher, and four others attend graduate school. The plaintiffs argued that they each relied on the government’s promises that any information they provided in the application process would not be used for immigration enforcement, and that barring criminal activity or fraud in their DACA applications, DACA recipients would be able to renew their status and keep their benefits. They also argued that the revocation of DACA is fueled by President Trump’s anti-Mexican racial animus evidenced in his past statements and actions. Moreover, the plaintiffs stated that the government took “affirmative steps to reduce the protections applicable to information provided in connection with the DACA program” as evidenced by a January 2017 Executive Order mandating that all agencies “ensure that their privacy policies exclude persons who are not United States citizens or lawful permanent residents from the protections of the Privacy Act regarding personally identifiable information.”

On January 9 2018, a federal district court judge in California issued a nationwide preliminary injunction in one of the related cases, ordering that DACA remain in effect on the same terms and conditions that existed prior to Trump’s rescission.  The ruling has created a new opportunity for young people all over the country to obtain work permits and pursue their education without the immediate threat of deportation.
