Message from the Courts Regarding Sealed Records and the iCourt Portal

There are two elements for the handling of sealed records in Idaho’s state courts. Idaho Court Administrative Rule 32 describes the process for sealing and redacting records. But the practical steps of actually configuring a sealed record take place within the Judicial Branch’s electronic case management system.

Currently, when a court record is ordered sealed, it is hidden from view in the public iCourt portal and public courthouse kiosks. It is also hidden from view for extended access users and for users of the attorney of record portal.

However, users of these systems are still able to see the case event related to the sealed record and any information a clerk added to that event. This behavior by these sites was never intended to be the case and does not align with the requirements of the rule.

Starting Wednesday, Sept. 24, these case events for records that are otherwise sealed will no longer be visible through the portals. This change only affects the case event for a sealed record itself. An order to seal that accompanies a sealed record as described in ICAR 32 will remain publicly accessible.

This change more closely aligns the case management system with the requirements of ICAR 32. If you have questions about accessing specific documents or case information, please contact the clerk’s office where the case is filed.
