Join the Government and Public Lawyers Section for a morning of discussion covering the myriad of issues surrounding the COVID-19 pandemic and the response and responsibilities of our state and local governments.  The three panel sections on the division of government responsibilities and powers will be: (1) federal and state; (2) state, county, and police; and (3) municipal powers and government employers.

9:15 a.m.   Federal, State Governor, and State Health District Powers Panel Discussion

Brian C. Wonderlich, General Counsel for Governor Brad Little, Adam Warr, Deputy for the Office of the Idaho Attorney General, Contracts & Administrative Law Division, and Charles I. Wadams, City Attorney & Risk Manager for Garden City

Topics will include:

  • The governor’s executive emergency powers;
  • The state health district’s emergency powers; and
  • The division of government responsibilities and responses under the Federal CARES Act.

10:00 a.m.   State Legislature, County, and Police Powers Panel Discussion

Topics will include:

  • The Special Legislative Session (immunity and elections);
  • Absentee voting during the pandemic;
  • What level of government is responsible for medical issues; and
  • Police tactics during the pandemic (use of force and police response during the Special Legislative Session).

  • Can municipal government require the public to wear masks, or otherwise adopt regulations to address the pandemic, or is there preemption;
  • Open meeting rules for municipalities during the pandemic;
  • Government employment issues during the pandemic and back to work plans;
  • Can a government employer require people to wear masks; and
  • Can a government employer require employees to get a vaccine.
