Supervising Attorney Qualifications

  • Must be a member in good standing of the Idaho State Bar and have practiced law within the state of Idaho for a period of at least five (5) continuous years prior to the submission of the application.
  • Faculty members at the University of Idaho College of Law shall be exempt from the condition requiring that they be a member of the Idaho State Bar so long as they meet the following criteria. He or she must: (1) be duly employed as a permanent or visiting faculty member of the University of Idaho College of Law, (2) have been admitted by examination to and be a member in good standing of the bar of another state or the District of Columbia, (3) agree to follow and be subject to the Idaho Rules of Professional Conduct, and (4) have practiced law for a period of at least five continuous years prior to submission of the application.
  • Without the express approval of the Board of Commissioners, no attorney shall be become a supervising attorney if he/she has even been censured, reprimanded (publicly or privately), suspended, or disbarred, or if he or she is, or within the previous twelve (12) months has been, the subject of any grievance received by the Idaho State Bar which has not been resolved in the attorney's favor. If a grievance is filed against an attorney while the attorney is serving as a supervising attorney, and the grievance is resolved against the attorney, the Board of Commissioners may require that the legal intern be advised of the matter or that the attorney withdraw as a supervising attorney.
  • Only one legal intern can be supervised at a time, unless the supervising attorney is part of the University of Idaho Legal Aid Clinic.
